第１条（本規約） Article 1 (Terms and Conditions)

ElementX サーバー, ElementX Network（以下「当サーバー」とします）は、当サーバーが提供する「マルチプレイサーバー」及びコミュニティである「Discord」（以下「本サービス」とします）について、本サービスを利用するユーザー（以下「会員」とします）が本サービスの機能を利用するにあたり、以下の通り利用規約（以下「本規約」とします）を定めます。 ElementX Server, ElementX Network (hereinafter referred to as the "Server") has established the following terms of use (hereinafter referred to as the "Terms of Use") for users (hereinafter referred to as "Members") of the "Multiplayer Server" and the "Discord" community (hereinafter referred to as the "Service") provided by the Server in order to use the functions of the Service.

第２条（本規約の変更） Article 2 (Change of this agreement)

当サーバーは、必要と判断した際に、会員の承諾なしに本規約の変更ができるものとします。
変更後の通知は当サーバー公式のDiscordのお知らせより通知をするものとし、会員は当サーバー接続した時点で施行された利用規約に同意したと見なします。 The server reserves the right to make changes to this agreement at any time without the consent of the member if it deems it necessary.
If you are a member of this server, you are considered to have agreed to the Terms of Service when you connect to this server.

第３条（損害賠償） Article 3 (Compensation for Damages)

会員は、本サービスの利用により当サーバーまたは他者に対して損害を与えた場合、自己の責任と費用をもって損害を賠償するものとします。 In the event that a member causes damage to this server or others through the use of this service, the member shall compensate for the damage at their own risk and expense.

第４条（禁止事項） Article 4 (Prohibited Matters)

本サービスの利用にあたり、以下の各号のいずれかに該当する行為を禁止します。
会員の行為が以下の各号のいずれかに該当すると当サーバーが判断した場合には、事前に通知することなく、当該行為の全部または一部を停止させ、当該違反行為を排除するあらゆる措置を講じることができるものとします。
・他者への迷惑行為を防止する目的で作成、利用されている「サーバールール」に反する行為
・当サーバーもしくは他者の著作権、商標権などの知的財産権を侵害する行為
・他者の財産、プライバシーもしくは肖像権を侵害する行為
・当サーバー、本サービスのコンテンツ提供者、その他第三者の名誉もしくは信用を毀損する行為
・本サービスによりアクセス可能な当サーバーまたは他者の情報を改ざん、消去する行為
・個人情報を、他の会員や第三者に漏洩する行為
・他人になりすまして本サービスを利用する行為
・政治活動、宗教活動、またはそれらにつながる行為あるいは公序良俗に反する行為
・許可なく当サーバーの名称または明らかにその内容が含まれた名称を使用する行為
・会員資格の第三者への利用許諾、貸与、譲渡、売買、その他担保に供する行為
・本サービスの運営を妨害しようとする行為
・本サービスの目的に反し、犯罪に結びつく行為
・その他、理由の如何をとわず当サーバーが不適切と判断する行為 In using this service, any of the following actions are prohibited.
In the event that the server determines that a member's actions fall under any of the following items, the server may, without prior notice, suspend all or part of said actions and take any and all measures to eliminate said offending actions.
・Actions that violate the "Server Rules" that are created and used for the purpose of preventing annoying actions to others.
・Infringement of intellectual property rights such as copyrights and trademarks of this server or others.
・Acts that infringe on the property, privacy or portrait rights of others
・Actions that defame the reputation or credibility of this server, the content providers of this service, or other third parties.
・Falsification or deletion of information on this server or others that can be accessed through this service.
・Leakage of personal information to other members or third parties.
・Use of this service by impersonating another person
・Political activities, religious activities, or activities that lead to such activities, or activities that are offensive to public order and morals.
・Using the name of this server or any other name that clearly contains its contents without permission.
・Acts of licensing, lending, transferring, selling, or otherwise offering membership to a third party as collateral.
・Acts that attempt to interfere with the operation of this service.
・Actions that violate the purpose of this service and lead to crimes.
・Any other actions that this server deems inappropriate for any reason whatsoever.

第５条（サービスの変更・終了） Article 5 (Change / termination of service)

当サーバーは、会員への事前の通知なく、本サービスの内容・名称の変更を行うことができるものとします。
但し、本サービスの終了をする場合には、当サーバーのDiscordにあるお知らせから会員へ公表するものとします。
なお、当サーバーは変更等によって会員または他者が被った損害について、この会員規約で特に定める場合を除き、一切の責任を負わないものとします。 The server reserves the right to change the content and name of the service without prior notice to members.
However, if this service is to be terminated, it will be announced to the members via the Discord announcement on this server.
The server shall not be held responsible for any damages incurred by members or others due to changes, etc., unless otherwise specified in this membership agreement.

第６条（サービス並びにコンテンツの中断または停止） Article 6 (Interruption or suspension of services and contents)

当サーバーは、以下のいずれかの事由が生じた場合には、会員に事前に通知することなく、一時的に本サービス並びにコンテンツを中断または停止することがあります。
なお当サーバーは、以下のいずれか、またはその他の事由により本サービス等の提供の遅延または中断、停止などが発生したとしても、会員または他者が被った損害について、この会員規約で特に定める場合を除き、一切の責任を負わないものとします。
本サービス等用設備などの保守を定期的に、または緊急に行う場合
火災、停電などにより本サービス等の提供ができなくなった場合
地震、津波などの天災により本サービス等の提供ができなくなった場合
戦争、動乱、暴動、労働争議などにより本サービス等の提供ができなくなった場合
その他、運用上または技術上あるいは当サーバーの都合により、本サービス等の一時的な中断が必要と判断した場合
The server may temporarily suspend or terminate the service and contents without prior notice to members in the event of any of the following events.
The server shall not be held responsible for any damages incurred by members or others due to delays, interruptions, or stoppages in the provision of the service due to any of the following or other reasons, unless otherwise specified in this membership agreement.
When performing periodic or emergency maintenance on equipment for this service, etc.
In the event that the provision of the Service, etc. becomes impossible due to fire, power failure, etc.
In the event that the provision of the Service, etc. becomes impossible due to a natural disaster such as an earthquake or tsunami.
In the event that the provision of the Service, etc. becomes impossible due to war, disturbance, riot, labor dispute, etc.
In any other cases where it is deemed necessary to temporarily suspend the Service for operational or technical reasons, or for the convenience of this server.

第７条（免責） Article 7 (Disclaimer)

当サーバーは、本サービス等の利用に際して利用者に生じた不利益や損害などに対して、一切の責任を負わないものとします。
利用者が、本サービス等から得る情報などについての一切は、利用者の責任において判断するものとし、当サーバーは、いかなる保証も行なわないものとします。
利用者が使用する機器およびソフトウェアについて、当サーバーは、その動作保証は一切行なわないものとします。
This server assumes no responsibility for any disadvantages or damages incurred by users in the use of this service, etc.
The user shall be responsible for all information obtained from this service, etc., and this server makes no guarantees whatsoever.
The server does not guarantee the operation of any equipment or software used by the user.

第８条（会員の取消） Article 8 (Cancellation of Membership)

会員が次の各号のいずれかに該当する場合、当サーバーは、当該会員に事前に通知を行うことなく本サービスの使用を退会処分とすることができるものとします。
第４条各号の禁止事項のいずれかに該当し、またはその他本規約に違反することが判明した場合
サーバールールの禁止事項のいずれかに該当し、またはその他本規約に違反することが判明した場合
反社会的勢力であるか、もしくはそうした勢力と関係がある、もしくは過去に関係があった場合
法令違反、犯罪もしくは、それらのおそれのある行為をした場合、または刑事事件に関与している疑いがあり、本規約を継続することによって当サーバーの信用が害されるおそれがある場合
その他、当サーバーが会員として不適当と判断した場合
In the event that a member falls under any of the following items, the server shall be able to withdraw the member from the service without prior notice to the member in question.
If you are found to fall under any of the prohibited items in Article 4 or otherwise violate these Terms.
If you are found to fall under any of the prohibited items in the server rules or otherwise violate these terms and conditions.
If you are an antisocial force, have a relationship with such a force, or have had a relationship with such a force in the past
If the user has committed a violation of law, a crime, or a potential crime, or is suspected of being involved in a criminal case, and there is a risk that the credibility of this server will be harmed by the continuation of these terms.
In the event that the server deems you to be an inappropriate member.

第９条（個人情報） Article 9 (Personal information)

会員の個人情報は、第３条、第４条、第８条、第１１条、会員登録時ならびにサーバールールに関して使用する物とし、その他の利用目的はないものとします。
個人情報は以下の項に従い扱う物とします
・個人情報の第三者への開示・提供の禁止（ただしご本人の同意や法令による開示が必要な場合を除く）
・会員情報の修正、変更を行う場合はご本人の同意のもと扱うものとする
Members' personal information shall be used for the purposes of Article 3, Article 4, Article 8, Article 11, membership registration, and server rules, and shall not be used for any other purposes.
Personal information shall be handled in accordance with the following terms
・Prohibition of disclosure or provision of personal information to third parties (except when disclosure is required by the consent of the person concerned or by law)
・Modifications or changes to member information will be handled with the consent of the individual.

第１０条（接続拒否状態からの復帰） Article 10 (Return from connection refusal state)

会員は第４条に反した場合は当サーバーを操作する者（以下「当権限者」）が接続拒否状態にする行為ができるものとします。
接続拒否状態から戻る場合は当サーバー公認であるDiscordグループのチケット上から申請を送るものとし、それ以外からの申請は一切無視するものとします。
解除申請は必ずしも全て行うというものではなく、当権限者が復帰可能とか判断した場合のみ行うものとします。
復帰が行えない者と判断し、それによる理由は一切答えないものとします。
接続拒否理由があまりにも悪質な場合はたとえ証拠がなくても当権限者が判断した場合は接続拒否ができるものとします。
In the event that a member violates Article 4, the person who operates the server (hereinafter referred to as the "authorized person") may reject the connection.
If you wish to return from a connection denied state, you must send a request on a Discord group ticket that is approved by this server, and all other requests will be ignored.
It does not necessarily mean that all requests for cancellation will be made, but only when the authority judges that it is possible to return.
We will judge that the person cannot return and will not give any reason for this.
If the reason for refusal of connection is too malicious, even if there is no evidence, the authority may refuse the connection if it deems it necessary.

第１１条（会員の凍結） Article 11 (Freezing of members)

会員は第４条に反した場合は当サーバーを操作する者に於いて、第８条とは別に会員を保持したままその会員情報を凍結することができるものとする。
一度会員の凍結が行った場合、この状態での接続をした場合は端末識別番号、IPアドレス、及びXboxに紐づけられたIDによる接続拒否を行うものとする。
ただしDiscordの凍結は処罰方法に準拠するものとする In the event that a member violates Article 4, the person operating this server may freeze the member's information while retaining the membership, in addition to Article 8.
Once a member has been frozen, any connection made in this state will result in a denial of connection based on the terminal identification number, IP address, and ID associated with the Xbox.
However, Discord freezes shall be in accordance with the punishment method.

第１２条（準拠法、裁判管轄） Article 12 (Governing law, jurisdiction)

本利用規約の解釈にあたっては日本法を準拠法とします。
本サービスに関して紛争が生じた場合には、管理者の所在地を管轄する裁判所を専属的合意管轄とします。 These Terms of Use shall be governed by and construed in accordance with the laws of Japan.
In the event of a dispute regarding this service, the court with jurisdiction over the location of the administrator shall have exclusive jurisdiction.
